Terms of Service
Effective as of the date of publication. Please review periodically.
Agreement to terms
By accessing or using the VISIONNAIRE website, application, or related services operated by Agetus ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the services.
The service
VISIONNAIRE provides an interactive experience that may include image upload, AI-assisted analysis, visualizations, and document exports for inspiration and executive review. Outputs are generated automatically and may be inaccurate, incomplete, or unsuitable for any particular purpose.
Not professional advice
Nothing on VISIONNAIRE constitutes architectural, engineering, legal, tax, financial, or other professional advice. You are solely responsible for engaging qualified professionals before relying on any output for design, construction, compliance, or investment decisions.
Your content
You retain rights to images and materials you submit. You grant us permission to process that content through our systems and third-party providers (for example, AI and hosting vendors) solely to operate and deliver the service. You represent that you have the rights to submit the content and that it does not violate applicable law or third-party rights.
Acceptable use
You may not misuse the service—including attempting to overload systems, probe vulnerabilities, scrape at scale without permission, upload unlawful or harmful content, or use outputs to harass, defraud, or mislead others. We may suspend or terminate access for violations.
Commerce
If you purchase paid features, additional terms presented at checkout (including from our payment processors) may apply. Prices and offerings may change. Unless required by law, fees are generally non-refundable.
Disclaimer of warranties
The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.
Limitation of liability
To the fullest extent permitted by law, Agetus and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability for claims arising from the service shall not exceed the greater of (a) the amount you paid us for the service in the twelve months before the claim or (b) one hundred U.S. dollars (US $100).
Indemnity
You will defend and indemnify Agetus and its affiliates against claims arising from your content, your use of the service, or your breach of these terms, subject to applicable law.
Changes
We may modify these terms from time to time. Continued use after changes become effective constitutes acceptance of the revised terms. For material changes, we will use reasonable efforts to provide notice where appropriate.
Governing law
These terms are governed by the laws applicable to Agetus’s operating jurisdiction, without regard to conflict-of-law principles, except where mandatory consumer protections in your country say otherwise.
